The first judicial cases have assumed that there is such a cause for annulment. However, the reasoning given to reach such a conflictive solution is extremely weak, technically not very rigorous, so it is highly likely that these decisions will be reversed by the higher judicial instances. In any case, the price of this defective legislation is the extreme increase in legal insecurity, in an increasingly stressed legal systemct.En España, el artículo 2 del Real Decreto-ley 2/2020, 27 de marzo suscita un grave problema interpretativo. Aunque el Gobierno parece buscar una prohibición del despido de las personas trabajadoras por causa de la crisis derivada de la covid19, en el texto legal no queda nada claro que se trate de un despido con causa prohibida y, por lo tanto, no conllevaría la nulidad del despido, sino solo una indemnización de despido (el coste de la arbitrariedad empresarial). Los primeros pronunciamientos judiciales han asumido que sí existe esa causa de nulidad.
