Gadamer’s philosophical hermeneutics broadens and detaches itself from the scientific model, which no longer meets the demands, and offers answers to solve the en-vironmental crisis. Philosophical hermeneutics proposes to overcome dogmatic paradigms and assists in the construction of paradigms that are more appropriate to the environmental changes faced by contemporary society. In this sense, the work, through the deductive and bibliographic methodological structure, focuses on the construction of a new paradigm for the realization of sustainable cities, from the legal and philosophical perspectives, discussing not only the institutional and normative elements related to the issue, but also and, mainly, the social implications, suggesting an emergency view to face the problems, and alternative ideas and paths to the realization of the right to a sustainable city.

A hermenêutica filosófica se propõe a superação dos paradigmas dogmáticos e auxilia na construção de paradigmas mais adequados as modificações ambientais enfrentadas pela sociedade contemporânea. Nesse sentido, o trabalho, através da estrutura metodológica de-dutiva e bibliográfica, tem como foco a construção de um novo paradigma para a efetivação de cidades sustentáveis, a partir das perspectivas jurídica e filosófica, discutindo não só os elementos institucionais e normativos relacionados à questão, mas também e, principal-mente, as implicações sociais, sugerindo um olhar de emergência para o enfrentamento dos problemas, e ideias e caminhos alternativos à efetivação do direito à cidade sustentável.La hermenéutica filosófica de Gadamer amplía y se desvincula del modelo cien-tificista, que ya no satisface las demandas, y ofrece respuestas para solucionar la crisis ambiental. La hermenéutica filosófica propone superar los paradigmas dogmáticos y ayuda a construir paradigmas más adecuados a los cambios ambientales a los que se enfrenta la sociedad actual.
