The present work is an effort to determine the influence of the Spanish
Inquisitorial Procedural Law from the XV to the XVIII centuries in the Guatemalan
criminal procedure until 1992 and the possible remnants of said system as a direct
consequence of a long and complicated legislative evolution in Guatemala.
The Spanish inquisitorial system, largely a product of the Spanish Inquisition,
constitutes one of the most influential institutions in the evolution of Criminal Law
and Criminal Procedure, both in Spain and in its former colonies in America, within
which Guatemala was included.
Given the enormous historical relevance of the Inquisitorial process, it is intended
to analyze what relationship exists between the inquisitorial process and the
Guatemalan criminal process until 1992 by virtue of the many regulations that
governed inquisitorial Law and reached the Guatemalan territory. Subsequently, the
comparison between these systems clarifies the origins of Procedural Law in
Guatemala and its respective metamorphosis over time.

El sistema inquisitorial español, producto en gran parte de la Inquisición Española, constituye una de las instituciones más influyentes en la evolución del Derecho penal y procesal penal, tanto en España como en sus colonias en América, dentro de las cuales se encontraba Guatemala. Ante la enorme relevancia histórica del proceso inquisitorial, se pretende analizar qué relación existe entre el proceso inquisitorial y el proceso penal guatemalteco hasta el año 1992 en virtud de que muchas normas que rigieron el Derecho inquisitorial llegaron a aplicarse en territorio guatemalteco.
