Based on recent contributions of socio-cultural theory, this paper explores the ontological tensions that link the modernity project with culturally diverse actors such as aboriginal communities of Colombia, trying to show the relationship between this social conflict and the possibilities of transformation towards a horizontal coexistence of legal systems. To do so, assuming as a concrete manifestation of this tension, it concentrates especially on the relation of the State legal system and the San Lorenzo indigenous community’s legal system, located in the Caldas department. The approach to the community was initially achieved through the Qirisia Qawai program that belongs to the practice curriculum of the Faculty of Law and Political Sciences of Universidad de Antioquia. From this analysis, it is concluded that despite a progressive constitutional and legal grammar concerning legal pluralism, the development of an intercultural project of healthy coexistence is delimited by transformative impulses in the social field that reverses the cultural hierarchies that arise from the scheme of modern thought. |
