Transitional justice is a mechanism aimed at solving a conflict that has generated serious violations of human rights and international humanitarian law. Transitional justice presents a dilemma between the need to live peace and the need to achieve justice. Peace and justice, as human rights, are norms that seek an ideal realization, so before the claim to make several of them in the same case they come into conflict. Given the impossibility of dispensing with peace or justice, both rights must be interpreted and applied in the most optimal manner allowed by the circumstances. Due to the need to overcome the conflict, this problem requires a pressing solution to unite the interests of citizens and allow reconciliation. For example, in Colombia society is manifestly divided between peace and justice. Proportionality offers a suitable interpretive resource to this obstacle, as it is a method that addresses the context and seeks the idyllic and optimal realization of human rights. So its use for the study of transitional mechanisms is imperative in order to allow the realization of peace and justice.

Elle présente un dilemme entre la nécessité de vivre en paix et celle d’appliquer la justice. La paix et la justice, comme droits de l’homme, sont des normes qui visent une réalisation idéale, de sorte que devant la prétention de réaliser plusieurs de ceux-ci sur un même cas elles entrent en conflit. Etant donné l’impossibilité de se passer de la paix ou de la justice, ces deux droits doivent être interprétés et appliqués de la manière la plus optimale étant données les circonstances. En raison de la nécessité de surmonter le conflit, ce problème requière une solution urgente afin de rassembler les intérêts des citoyens et permettre la réconciliation. Par exemple, en Colombie la société se trouve réellement divisée entre la paix et la justice. La proportionnalité offre une source d’interprétation idéale à ce problème en tant que méthode répondant au contexte et prétendant la réalisation idyllique et optimale des droits de l’homme. C’est pour cette raison que son utilisation pour l’étude des mécanismes transitionnels semble impérative dans le souci de permettre la réalisation de la paix et de la justice.A justiça transicional é um mecanismo orientado à solução de um conflito que tem gerado graves violações aos direitos humanos e ao direito internacional humanitário. A justiça transicional apresenta um dilema entre a necessidade de viver a paz e a de realizar justiça. A paz e a justiça, como direitos humanos, são normas que pretendem uma realização ideal, pelo que ante a pretensão de realizar vários deles em um mesmo caso entram em pugna. Dada a impossibilidade de prescindir da paz ou a justiça, ambos direitos devem ser interpretados e aplicados da maneira mais ótima permitida pelas circunstâncias. Devido à necessidade de superar o conflito, este problema requer uma solução urgente para aunar os interesses dos cidadãos e permitir a reconciliação. Por exemplo, em Colômbia a sociedade encontra-se manifestamente dividida entre a paz e a justiça. A proporcionalidade oferece um recurso interpretativo idôneo a este óbice, ao ser um método que atende o contexto e pretende a realização idílica e ótima dos direitos humanos.
