The purpose of this article is to determine clearly the true position of jurisprudence in the scale of sources of the commercial law in Colombia, and to specify its location as a main and an auxiliary source, following the criteria established by the Constitutional Court for this purpose.El Código de Comercio establece en sus nueve primeros artículos cuáles son las fuentes del derecho mercantil colombiano. Sin embargo, la entrada en vigencia de la Constitución Política de 1991 y los pronunciamientos de la Corte Constitucional han traído consigo modificaciones directas al sistema jurídico que orienta el derecho comercial, abriendo paso a la constitucionalización y la aplicación de la teoría del precedente judicial.
