For this purpose, a dogmatic historical methodology is followed, considering the regulation and the work of Bello, previous to the Civil Code of 1855, as well as the legal thought prevailing at that time in France and Spain. The author concludes that it is neither possible to link the regime of public goods in the Chilean Civil Code with the theory of the public domain developed in France from Maurice Hauriou nor with the contributions of later Spanish doctrine. In addition, the importance of the analysis lies in the influence that the Civil Code has had on the Chilean Constitution which establishes the bases of the legal regime of property, and where the property has a general character.El objetivo de este trabajo es establecer cuál fue el pensamiento de Andrés Bello respecto de los bienes públicos y cómo se regularon en la codificación civil chilena, como paso previo y necesario para formular una teoría general de los bienes públicos en el derecho chileno. Para tal efecto, se sigue una metodología histórica dogmática, que considera la regulación y la obra de Bello previa al Código Civil de 1855, así como el pensamiento jurídico predominante en aquella época en Francia y España. El autor concluye que no es posible vincular el régimen de los bienes públicos en el Código Civil chileno con la teoría del dominio público desarrollada en Francia a partir de Maurice Hauriou, como tampoco con los aportes de la doctrina española posterior.
