Summary: This article is a reflection on the legal recognition of the gender perspective on preservation of genetic resources and associated traditional knowledge. Methodologically, two strategies were used: one was theoretical, concerning documentary review of international and Chilean regulations on the subject, and the other was of an empirical nature based on interviews with Mapuche women to learn about their perception of their role in the preservation of genetic resources and traditional knowledge. This analysis allowed to conclude that the norm reviewed does not respond to the legal needs raised from the interviews, since the gender differences are not sufficiently addressed and do not guarantee an equal participation between men and women. This demonstrates the need to implement systematic processes to generate specific recommendations in terms of gender equity, in consultation processes, in national legal regulations, and in development policies and programs.
