This article offers an insight about the Advertisement
Law’s constitutionalization in Colombia. This process
has been built by judicial means, and more specifically
by the Colombian Constitutional Court in abstract
judicial review decisions. This text’s main purpose
is to determine whether the Advertisement Law
could be categorized as an expression of a specific
constitutional right in order to identify the extent
of the appreciation margin given to the legislative
branch while it imposes limitations, restrictions or
prohibitions to this activity. Thus, this margin will be
different if the Advertisement Law can be categorized
as a fundamental right concrete example rather than
a right whose main content is economical. |
