This study aims to determine if these contracts, in which the borrower is an interested party due to the possible benefit that may be obtained, distort the legal concept of the commodatum, and its essential gratuitousness.El contrato de comodato es una figura poco estudiada por la doctrina y confundido por la jurisprudencia con otras figuras afines. Sin embargo, hoy día, la importancia de conservar intacto el patrimonio y de adquirir beneficios constantes derivados del mismo, ha provocado que el título gratuito haya cedido casi enteramente el puesto al título oneroso, favoreciéndose aquellos contratos que suponen algún ingreso en el activo, como es el contrato de comodato.
