This imposes on States a set of obligations designed to protect against violation of human rights, especially from a legal standpoint which should put in exercise the standards of rights, norms and legal principles thus guaranteeing “the effective access to justice of people in vulnerability condition without discrimination”. In The case of Gabriela Blas, an Aymaran pastor convicted by the Chilean criminal system, the dispute and conflict between the “Western legal tradition” and “the new legal dogma” of an American ius for respect for difference was evident. The State, failing in its duty of due diligence and care, ignored the international constructs around gender and interculturality, both accepted into the dogma and jurisprudence of the Inter-American Court of Human Rights as expressions of a democratic and culturally diverse State, minimum demands for a true integration.El proceso de integración americana enfrenta los desafíos de conciliar la globalización, los localismos y los derechos específicos de diversos grupos que han emergido como sujetos internacionales tales como los pueblos indígenas y las mujeres. Esto impone a los Estados un conjunto de obligaciones dirigidas a proteger contra las violaciones de los derechos humanos en especial a la función judicial que debe poner en ejercicio los estándares de derechos, normas y principios jurídicos garantizando “las condiciones de acceso efectivo a la justicia de las personas en condición de vulnerabilidad, sin discriminación alguna”1 , En el caso de Gabriela Blas, una pastora aymara castigada por el sistema penal chileno, se evidenció la disputa y conflicto entre “la tradición jurídica occidental” y “la nueva dogmática jurídica” del ius americano por el respeto a las diferencias.
