Finally, it establishes the role of the victim against the State and the illegality consequences from the International Law perspective..El presente artículo analiza si los instrumentos de justicia transicional derivados del marco jurídico para la paz en Colombia, en especial el mecanismo de suspensión total de ejecución de la pena, constituye un hecho ilícito internacional. Para tal fin, se realiza una aproximación al sistema de responsabilidad internacional del Estado en el derecho internacional de los derechos humanos, haciendo énfasis en la prohibición de concesión de amnistías, indultos o figuras jurídicas que establezcan sistemas de impunidad.
