This institution has not been systematically approached but has aroused dissimilar criteria from the General Comptroller of the Republic as from the second subsection of the 46th article. The interpretation of the administrative jurisprudence is contrasted with the existing requirements of a state monopoly, as well as the right to develop any economic activity and the concept of public faith.Este artigo analisa um dos problemas da lei chilena sobre procedimento administrativo, que é a eventual competência de monopólio para notificar os atos da administração do Estado por meio de cartas certificadas via empresa estatal. Essa instituição não vem sendo abordada de forma sistemática, mas vem suscitando diferentes critérios por parte da Controladoria Geral da Nação, a partir do segundo inciso do artigo 46. Contrasta-se a interpretação da jurisprudência administrativa com os requisitos da existência de um monopólio estatal, bem como o direito ao desenvolvimento de qualquer atividade econômica e do conceito de “fé pública”.Este artículo analiza uno de los problemas de la ley chilena sobre procedimiento administrativo, que es la eventual competencia monopólica para notificar los actos de la Administración del Estado a través de cartas certificadas por medio de una empresa estatal. Esta institución no ha sido abordada sistemáticamente, pero ha suscitado disímiles criterios de la Contraloría General de la República, a partir del inciso segundo del artículo 46.
