Summary: This article has as the main purpose of investigating the limitations of the current political and legal model for the management and guardianship of environmental goods in a global perspective, especially based on the reflections brought by the RIO+20 Environmental Conference which took place in Rio de Janeiro in June 2012. With the use of the inductive method, it is described how in the present at risk Society there is a crisis/lack of global governability which makes the implementation of new management and regulation models convenient and necessary. This crisis/lack of governability is a consequence of the state model exhaustion, limited by territorial boundaries as well as by the deficiency of the legal system and logic of the present International Law to carry out efficient guardianship of the planet and the environment, especially regarding future risk and protection of future generations. This article tries to confirm that the development of new transnational environmental governability strategies, capable of articulating supporting, democratic and cooperative attitudes which bring people, institutions and States together in the fight for protection of goods and values essential to ensure a decent sustainable and promising life for future generations, is essential.
