This study is justified because of the serious decrease in public assets problem in Colombia. The topic is dealt with from the analysis of the Consejo de Estado sentences between 2005 and 2010 related with the application and results of the Repetition Action where it was found that: the implementation of the norm and its holoistic development is not consolidated; there is no immediate effect because of the delay in the legal processes; there is negligence from public servants and meaningful effects to safeguard public resources are not sonsolidated. The consolidation of public ethics that favors morality and efficiency is demanded.La responsabilidad de los servidores públicos en materia de Repetición como fi gura jurídica, apenas produce sus primeros resultados; en este artículo se presentan avances del trabajo de investigación que evalúa las causas de la inoperancia de la ley 678 de 2001, estudio que se justifi ca por el grave problema de detrimento al patrimonio público en Colombia. El tema es abordado a partir del análisis de las sentencias del Consejo de Estado en el período 2005-2010, relacionadas con la aplicación y resultados de la Acción de Repetición, encontrándose que no se consolida la implementación de la norma y su desarrollo integral; no existe efecto inmediato por el retraso en los procesos judiciales; existe negligencia de servidores públicos y no se consolidan efectos signifi cativos para salvaguardar los recursos públicos.
