Using various contradictions solving techniques , a solution is proposed, which is the contribution of this study and which goes beyond jurisprudential rulings that might arise in the future.La acción de clase es uno de los principales instrumentos para la protección del medio ambiente en Colombia. Las acciones de clase han reconocido un incentivo económico. Sin embargo, la Ley 1425 de 2010 derogó dos artículos de la Ley 472 de 1998 que reconocían el incentivo. Pero no se ha estudiado si la recompensa en virtud del artículo 1005 del Código Civil sigue en vigor.
