The possible weakness that for the buyer can derive from that explanation must be corrected by strengthening his position through the protection of rights in expectation. This ensures that both the seller and the buyer enjoy adequate protection in case of enforcement or bankruptcy of the other party or transmission of the property to a third person.El pacto de reserva de dominio se ha convertido en una de las instituciones más controvertidas de nuestro Derecho de contratos. Entre las diversas construcciones que intentan explicar la figura, la de la condición suspensiva de la transmisión es la que mejor responde, no solo a la voluntad de las partes y a su declaración, sino también a la defensa de sus intereses. La posible debilidad que esa explicación puede producir en la posición del comprador se debe corregir fortaleciendo su titularidad mediante la protección de los derechos en expectativa.
