The responsibility of service providers in the web 2.0. for the contents integrated by the users is analyzed. The author
defends and exposes the general solution in the US: the general exclusion of liability that protects providers and intermediaries. Whit this model “Collateral censorship” and the “chilling effect” on freedom of expression are avoided. As regards
Europe, judgments such as the Delfi case of 2015 of echr and the insufficient Directive 2000/31/EC or Law 34/2002 in
Spain are analyzed. The European system is criticized for its fragmentation, decisionism, legal insecurity and because this
model is negative for freedom of expression. However, it is noted that a reform is not planned. Finally, some proposals are
made. |
