Based on Derrida’s ideas, we attempt to map the fundamental aspects of the Law and Literature approach, as well as its meaning regarding philosophy. By studying Derrida, however, we do not hinder the dialogue with other thinkers, who may have influenced him as well as opened up the possibility for disagreeing in substantial matters, such as the supposed possibility of literature to “say everything”. Thus, the non-institutionality of literature and its intrinsic democratic power are hereby explored as fundamental elements to see this approach as more than casual. With its invaluable capacity of raising questions, literature is a powerful rival to totalitarian regimes and a strong democracy fosterer. Furthermore, with the aesthetic pleasure granted by its narratives, literature also has a deconstruction trait, and it shields us against the ever-present risks of decisionism.Este trabalho propõe-se a analisar, de forma tópica e problemática, o célebre texto de Jacques Derrida intitulado Essa estranha instituição chamada literatura, buscando suas possíveis implicações para o direito e para o pensamento jurídico. A partir do texto derridiano, procuramos refletir sobre pontos fundamentais do movimento, bem como seu significado e relação com a filosofia. Ao seguir o rastro de Derrida, não nos esquivamos, contudo, de colocar seu pensamento em diálogo com o de autores que o influenciaram e, ao mesmo tempo, abrem caminhos para divergências em temas fundamentais, como a suposta possibilidade de a literatura “dizer tudo”. Assim a não institucionalidade da literatura e seu intrínseco potencial democrático são aqui explorados como elementos fundamentais para que possamos ver nessa relação muito mais que uma mera aproximação fortuita. Com sua inestimável capacidade para suscitar perguntas, a literatura coloca-se como poderosa adversária de regimes autoritários e fomentadora da democracia.
