description
This article deals with the notion of a face-to-face encounter as something essential for restorative justice. Within a qualitative methodology and departing from the situation created by the COVID-19 crisis, its pages have an exploratory objective with regard to the possibilities of a distance restorative justice without physical contact among its participants. First, we will mention the surprising lack of specific international or internal regulation on this matter. To do this a content analysis of the most relevant norms will be developed. Second, through a literature review, restorative justice projects will be described in different countries affected by the COVID-19 crisis. Some prospective elements will be tackled with the so-called three tomorrows theory. The use of artificial intelligence in the criminal justice system will be mentioned. Finally, we will incorporate to this debate some aspects of the concept of resonance by Hartmut Rosa. This can be related to the potentialities and risks of a tele-justice in relation to the need for an embodied Victimology. In order to do so some illustrative excerpts of responses to questionnaires with four Spanish facilitators in different public services of restorative justice will be included.
