On this new scenario, much has also been discussed about the applicability of that model in the public service, aiming some constitutional limitations, among them the principle of public tender. By bibliographical research and the deductive method it is intended to analyze the constitutionality of Decree 9.507/2018, which defines the outsourcing in the scope of the Federal Public Administration.Recentemente afloraram no Brasil discussões a respeito da terceirização devido às significativas alterações causadas pela Reforma Trabalhista. Isso porque as Leis 13.429/2017 e 13.467/2017 possibilitaram o uso do instituto de forma ampla no setor privado. Diante desse novo cenário, muito se tem discutido também sobre a aplicabilidade do modelo no setor público, tendo em vista algumas limitações constitucionais, dentre elas o princípio do concurso público.
