Prior to the reform of the Penal Code of 1973 in 1983, in Spain had not occurred an addition to the criminal legislation of the error and its consequences, raising doubts about whether or not it was irrelevant and what effects it had. The study of the effects of the error on the mitigating and aggravating factors becomes fundamental for the correct imposition of the sentence.El tratamiento del error es una de las cuestiones más estudiadas por la doctrina penal española que ha desembocado en la aplicación por los Tribunales con ocasión de determinadas conductas. Multitud de autores españoles y alemanes tratan de arrojar luz sobre el concepto del error, las distintas clases del mismo y el tratamiento de las consecuencias de estas clases de error. Anteriormente a la Reforma del Código Penal de 1973 en 1983, en España no se había producido una incorporación a la legislación penal del error y sus consecuencias, generando dudas sobre si era o no irrelevante y qué efectos tenía.
