The aim of this paper is to analyse the impact that the recognition of the
right to free legal assistance to the plaintiff may have, in relation to the regime for the adoption of
precautionary measures. In particular, it analyses the impact that the plaintiff´s insufficient
financial resources may have on the enforceability of the caution or guarantee imposed by the LEC
or, where appropriate, on the determination of its amount. |
