Summary: The following work analyses the application of the legitimacy rules provided for in Articles 87, 88 and 89.3 of the Statute of workers to the non-union and union representatives who can negotiate collective agreements of general application. Previously, the constitutional foundations that enable each of the two types of workers’ representative bodies are discussed, thus discerning the different role that the Constitution has for each of them. From this perspective the next part of the work analyses existing case law on negotiating legitimacy, separating each of the initial, full and decisive legitimization. Thus, the work highlights the strict application of the ‘correspondence principle’ when negotiating collectively unitary representation bodies while, in the case of the unions, the demands of compliance with the triple bargaining legitimization are interpreted according with the social function that trade unions fulfill under Article 7 of the Constitution.
