The proliferation of the so-called “atypical workers” and, in a very significant way, of the “false self-employed workers” has caused an important breach of social cohesion and the “de-unionization” of collective bargaining. The recent legal conflicts around these issues make it very important to establish the legality applicable to these new subjects in the field of labor relations, especially in regard to their collective bargaining rights and their coexistence with the right to free competition. The social dialogue must play a leading role in the processes of transition to the digital economyEl devastador impacto de la “deslocalización” de los medios de producción, como instrumento utilizado por el empleador para minimizar los “costes laborales”, ha alcanzado su máximo exponente en la llamada “cuarta revolución industrial”. La proliferación de los llamados “trabajadores atípicos” y, de manera muy significativa, de los “falsos autónomos”, provoca importantes quiebras de cohesión social y la “desindicalización” de la negociación colectiva. Los conflictos jurídicos recientes alrededor de estas realidades hacen que resulte muy importante establecer la legalidad aplicable a esos nuevos sujetos en el ámbito de las relaciones laborales, en especial en lo que se refiere a sus derechos de negociación colectiva y su convivencia con el derecho de libre competencia.
