Les Droits de l’Homme dans les politiques migratoires brésiliennes: Droits des migrants au regard d’un changement de paradigme législatif
Summary: In 2017, Brazil enacted Law No. 13.445/2017, which governs the country’s migration policies country based on the paradigm of human rights. The promoters of this new legislation sought to oppose current immigration policies that criminalize migrants around the world. However, the progress made by Law No. 13.445/2017 for the defense of migrants’ fundamental rights are now being threatened by new legal texts (Portaria 770/2019 and Draft Law No. 1928). These are driven by conservative trends that seek to consolidate the criminal approach to migration. This article proposes a socio-anthropological study on the implementation of an immigration policy based on the pillars of human rights: its advances, its limits and the debates that surround it. Based on the concepts of "national order" and "methodological nationalism", the study examines the resurgence of nationalist ideologies that revert to prioritizing policies based on the principle of security and the representation of migration as a threat. Finally, the article reflects in favor of human rights movements in Brazil that have been challenged by a recently elected populist and far right-wing government.
