Summary: Starting from the traditional distinction of public goods between public goods, destined for public uses and services, and assets, destined for their economic profitability, their characteristics and forms of use are analyzed, in accordance with the current patrimonial regulations, for, then focus on public property: social housing, making a historical analysis of its legal configuration, and trying to identify, in the absence of an express legal provision, the features that would include it in one or another category of property. Thus, it is concluded that in those public goods own elements concur, both of the public goods, as well as the assets. Based on this consideration of housing, a blurring between these two traditional categories is observed, within the framework of a social State, which leads to the management of public assets as an element for the fulfillment of social policies, and to propose changes in the procedures of alienation of goods, avoiding recent examples of doubtful efficacy for the general interest.
