Laburpena: In this research article, the evidence on jurisdictional guarantees, its lack of regulation and its effect on the right to defense and probation are analyzed. What is intended to demonstrate is that the procedures that are currently used, regarding the performance of the test, are not regulated and that the criteria are other. For this, mixed type research was used, that is to say quantitative and qualitative, mainly descriptive with an empirical cut in order to demonstrate the urgent need to reform the Organic Law of Jurisdictional Guarantees and Constitutional Control, which rigorously determines the procedure to be must continue in the performance of the test in the Jurisdictional Guarantees processes, thus guaranteeing the rights of defense and probation.
