Desta forma, são levantadas críticas severas sobre o mito insustentável da estabilidade legal. E prescreve a mudança da concepção de Direito em favor de uma concepção mais realista e pragmática, de acordo com as características estruturais do constitucionalismo atual. Y se prescribe el cambio de la concepción del Derecho en favor de una concepción más realista y pragmática acorde con los rasgos estructurales del constitucionalismo actual.
