This paper addresses the adoption of same-sex couples in Colombia, in orderto point out how this action achieves the restoration of the children and adolescentsrights in Colombia in a vulnerability status. Thus seeking the comprehensive protectionand safeguard of the best interests of the child. Furthermore, it is evident that Colombia–as a social rule of law State- is a protective and guarantor State, that regarding humandignity, equality, the free development of personality, and the recognition of pluralismhas recognized several rights patrimonial and personal rights to homosexual people, suchas starting a family and the possibility of adopting. Hence, this case-law progress anda new social reality have shown a favorable guarantee of the children and adolescents’rights, who find in adoption laws an effective restoration measure for their rights,regardless of the sexual orientation of the adoptive pretenses; and provided that theymeet all the requirements of substantial and procedural matters, both administrativeand jurisdictional. |
