The first part is intended to present Belo Monte Power Plant’s political-institutional background. The second part unfolds the details of the Public Civil Action, filed by the Federal Prosecution Service, which contests the formal and material procedures that authorized both environmental and affected communities’ hearing anthropological studies, according to the § 3 of Art. 231 of the Federal Constitution. The action was chosen as the object of the present study because it was the first judicial measure having a Supreme Court decision authorizing such studies on the grounds of possible injury to public order and public economy. The third part articulates the content of the decisions given by the judiciary during the procedures of the Public Civil Action, with emphasis to the Constitutional Court’s position on the issue. The fourth part presents technical-juridical considerations that were extracted from the analysis of the documents that composed this study.O presente estudo de caso está dividido em quatro momentos.
