Summary: Guatemalan legal system admits actions at a constitutional level, when the exercise of civic and political rights have been restricted or potentially threatened. For the claim to be submitted and the action to be viable, it is necessary to understand both the historical background of this action, and the essential requirements that make it possible. Therefore, before taking action it is necessary to understand that the purpose of this claim is to, either prevent or remedy any constitutional wrongs. Once the claimant has identified the specific violation of its fundamental right, it is mandatory that they comply with certain procedural requirements to ensure the issue is addressed. These procedural requirements and its exceptions can be found in the law, and on the Constitutional Court´s case law.
