The article is divided into four parts: the first briefly seen the background, the class action in common law and its reception in the United States until the issuance of Federal Rule of Civil Procedure 23; The second part addresses the requirements for admission and maintenance of the class action, and also the cases where it is possible to bring it to the judiciary; the third part, analyzes the figure of adequacy of representation, first from the conflict of interest, and then, from the various standards for his study, regarded to representative as his lawyer, finally, the effects of its absence and some innovative positions in the field. At the end the most important conclusions of the study are presented.El estudio abordó la temática de la representatividad adecuada en las acciones colectivas norteamericanas, como elemento garantizador del debido proceso de los miembros ausentes. El artículo se divide en cuatro partes: en la primera se observan someramente los antecedentes de la acción colectiva en el derecho anglosajón (common law) y su recepción en los Estados Unidos, hasta la expedición de la Regla Federal de Procedimiento Civil 23 (rfpc 23); en la segunda parte se tratan los requisitos de admisión y mantenimiento de la acción colectiva, además de los casos en que es posible traerla a consideración judicial; en la tercera parte se analiza la figura de la representatividad adecuada desde el conflicto de interés, luego desde los variados estándares para su estudio tanto frente al representante como a su abogado, así como los efectos de su ausencia en el proceso y algunas posturas innovadoras en la materia; finalmente se presentan las conclusiones más relevantes del estudio.2017text (article)application/pdfhttps://dialnet.unirioja.es/servlet/oaiart?codigo=7252107(Revista) ISSN 1909-7794Revista Derecho Privado: (Universidad de los Andes), ISSN 1909-7794, Nº. 57, 2017spaLICENCIA DE USO: Los documentos a texto completo incluidos en Dialnet son de acceso libre y propiedad de sus autores y/o editores. The purpose of this study, is to address the issue of adequacy of representation in class actions, as guarantor element of due process of absent members.
