However, for the transfer of property, national legislation stipulates (as per other rem rights) the confluence of both a title and a mode of acquisition, without which the transfer of the property is invalid. The moment of utmost significance is when the creditor acquires the property of the colateral. It is in that instant that the asset passes from the posession of the debtor to that of said secured creditor. This paper aims to establish some of the consequences of the elimination of the prohibition on the forfeiture agreement as well as analyze the basis for the acquisition of the asset offered as collateral by the aforementioned direct payment institution.La ley de garantías mobiliarias derogó la interdicción del pacto comisorio a la par que instituyó la figura del pago directo, por la que el acreedor se adueña del bien ofrecido en garantía ante el incumplimiento de la obligación. Sin embargo, el derecho nacional requiere para la transferencia del dominio —al igual que demás derechos reales—, la confluencia de un título y un modo, sin los cuales no se verifica la transmisión de esa propiedad. Dicho momento en el que el acreedor se hace dueño del bien con el que se garantizó la obligación resulta de vital importancia, por cuanto es en tal instante en el que la cosa sale del patrimonio del deudor para ingresar al del acreedor garantizado.
