Summary: Risks’ distribution is one of the most complex and persistent problems of contract law, and it is particularly relevant when the requirements for the application of the theory of imprevision are met. In Colombia, such institution is regulated under Article 868 of the Commercial Code, which prohibits the application of such theory in the case of aleatory contracts. This paper aims to critically evaluate such exclusion, by reviewing the relevant legislation, case law, and doctrinal literature. It is argued that the application of the theory of imprevision should not be determined by the classification of the contract, but rather by an evaluation of the risks assumed by the contracting parties
