A decision by the Supreme Court of California in Keating v. Superior Court in 1982 recognized a new form of arbitration
known as “class arbitration”, that is, the filing of a class action in an arbitral tribunal. This US initiative for resolving disputes has transcended the national level and has in fact been invoked in other jurisdictions, including Colombia. However,
there are currently disparate positions with respect to its origin where the arbitration agreement is silent on the matter.
This is due to the representative nature of the class action and the consensual nature of arbitration and thus means that
in principle these two methods appear incompatible. In this context, this paper aims to propose an alternative solution
to harmonize such mechanisms.

Superior Court de 1982, foi criada a class arbitration, isto é, o exercício de uma ação de classe em sede arbitral. Esta iniciativa estadunidense de resolução de controvérsias transcendeu a esfera nacional. De fato, teve lugar em outras jurisdições, entre elas, a colombiana. Porém, na atualidade existem posições dissimiles com respeito a sua procedência em caso de silêncio do pacto arbitral. O anterior, em razão à natureza representativa da ação de classe e ao carácter consensual da arbitragem, que faz com que em princípio estas duas figuras pareçam incompatíveis. Neste contexto, o presente artigo tem por objetivo propor uma alternativa que permita harmonizar os citados mecanismos.A partir de la decisión tomada por la Corte Suprema de California en el caso Keating v. Superior Court de 1982, se creó la class arbitration, esto es, el ejercicio de una acción de clase en sede arbitral. Esta iniciativa estadounidense de resolución de controversias ha trascendido la esfera nacional. En efecto, ha tenido lugar en otras jurisdicciones, entre ellas, la colombiana. Sin embargo, en la actualidad existen posiciones disímiles respecto a su procedencia en caso de silencio del pacto arbitral. Lo anterior, en razón a la naturaleza representativa de la acción de clase y al carácter consensual del arbitraje, que hace que en principio estas dos figuras parezcan incompatibles.
