This paper points out the questionability of that criterion, under the view of the national and European law, and the problems that it poses by its extension to other jurisdictions.Desde un punto de vista más práctico que doctrinal, se pretende dar una visión del criterio que establece el Auto dictado por la Sala de Conflictos del Tribunal Supremo con fecha 16 de octubre de 2019 que, resolviendo el conflicto negativo de competencia entre un Juzgado de Primera Instancia y otro de lo Social, decide que es competente este último para la ejecución de una resolución dictada por un tribunal francés concediendo una indemnización derivada de un contrato laboral.
