This subject has relevance when the causant is the owner of a Family enterprise or a Farming Production unit. This work shows the different obstacles that the causant of the inheritance has for dispose of the economical unit in favor of a heir, in order to keep the continuity of it, which in many cases can lead to the division of such enterprise or unit. For this reason, certain mechanisms are proposed for an adequate protection and conservation of the Family enterprise or the Farming production unit at the decease of the causant, but protecting properly the rights of the heirs in their reserved portion.Resumen En Chile, por aplicación del principio de intangibilidad de la legítima, el causante tiene ciertos inconvenientes para disponer de sus bienes a través del testamento, acudiendo, en algunos casos, a otras instituciones, fuera de dicho acto jurídico, para planificar su sucesión. Ello tiene relevancia cuando el de cujus es titular de una empresa familiar o explotación agropecuaria. El trabajo demostrará las diversas dificultades que tiene el causante para poder disponer de dicha unidad económica en favor de un legitimario, a objeto de mantener la continuidad de la misma, lo que, en muchos casos, pudiera llevar a la extinción o fraccionamiento de esa unidad.
