The second tradition originates in Roman law and mainly refers to the existence of written texts. In this convergence, the figure of the agreement is a key issue, because it establishes the political power legitimacy, the exercise of force and the ways of delimitation. In this way the Constitution is a legal text which describes political issues, refers in a legal way to political problems, and states political order as itself. The contribution of Derrida is essential to face a deconstructive approach in theoretical, practical, ethical-political, and legal decisions.Luhmann califica a “la constitución como adquisición evolutiva”1 cuya novedad consiste en que en ella convergen dos tradiciones semánticas y se transforman viejos contenidos de sentido. La primera de estas tradiciones (que aún se mantiene) refiere al concepto de estructura, a una conexión orgánica que mantiene unido al cuerpo social y político y que expresa una concepción de la temporalidad del derecho, que indica su vigencia. La segunda tradición, proveniente del derecho romano remite centralmente a la existencia de textos escritos. En esa convergencia, la figura del contrato es clave, ya que funda la legitimidad del poder político, el ejercicio de la fuerza y las formas de su delimitación. Así la constitución es un texto jurídico que textualiza cuestiones políticas, trata jurídicamente problemas políticos, determina el orden político como orden jurídico.
