Our Court applies the American Human Rights Convention and the International Human Rights Instruments granting them the same status as the National Constitution, as Article 75 Section 22 -included by the national amendment- stated, and following the decisions of the international control bodies. This paper tries to clarify the influence of the above mentioned article in the constitutional supremacy, as well as the limits that both constitutional and conventional controls have in their condition of procedural tool to enforce human rights.A través de los fallos más significativos de la Corte Suprema de Justicia de la Nación, en sus votos mayoritarios, se ha registrado un gradual e importante avance, desde la reforma constitucional de 1.994, en el alcance del control de convencionalidad por ella aplicado y exigido por las sentencias de la Corte Interamericana de Derechos Humanos. La Convención Americana de Derechos Humanos y los Tratados Internacionales de Derechos Humanos se aplican por nuestro más alto tribunal interno en pie de igualdad con la Constitución Nacional según lo establece el art. 75 inc. 22, incorporado por la reforma, y conforme las decisiones de los organismos internacionales de control.
