Laburpena: A gradual and relevant evolution has been registered at the National Supreme Court of Justice case law, in connection with the application of conventional control, which is required by the Inter American Court of Human Rights precedents ́ since the national constitutional amendment of 1994. Our Court applies the American Human Rights Convention and the International Human Rights Instruments granting them the same status as the National Constitution, as Article 75 Section 22 -included by the national amendment- stated, and following the decisions of the international control bodies. This paper tries to clarify the influence of the above mentioned article in the constitutional supremacy, as well as the limits that both constitutional and conventional controls have in their condition of procedural tool to enforce human rights.
