The transmission of text, sounds, images and software over the Internet has become commonplace, removing the barriers of space and time, allowing for ubiquitous and asynchronous communication. If appropriate legal standards are not set, the digital technology could be used to undermine the basic principles of copyright. Therefore a suitable le gal framework establishingbalanced competition to provide incentives to creators, performers and local producers, to supportsoftware industries and encourage the creation of new industries like necessary. This paper aims to detail the legal protection of software in most domestic laws and internationally and analyze their effectiveness.Las tecnologías digitales permiten la transmisión y utilización de todos los materiales protegidos por el derecho de autor y los derechos conexos en redes interactivas. La transmisión de textos, sonidos, imágenes y programas informáticos por Internet se ha convertido en moneda corriente, eliminando las barreras del espacio y el tiempo, facilitando una comunicación ubicua y asincrónica. Si no se establecen normas jurídicas apropiadas, la tecnología digital podría utilizarse para socavar los principios básicos del derecho de autor. En consecuencia es necesario un marco jurídico adecuado que establezca una competencia equilibrada que proporcione incentivos a los creadores, artistas intérpretes o ejecutantes y productores locales, que apoye a las industrias de software y aliente la creación de nuevas industrias similares.
