In this context, surrogacy is presented as a peculiar practice, generally deserving of a treatment disparate to the rest assisted reproductive techniques. This paper studies the position taken by those jurisdictions that do not accept surrogacy, and compares it to the positive treatment that other techniques receive from the same jurisdictions. In an attempt to understand this different approach, subsequently the mater semper certa est principle –inherited from Roman law- is addressed, since surrogacy deeply affects it. The paper finally questions the current validity of the maxim.En un escenario posmoderno de creciente infertilidad, quienes se ven imposibilitados de concebir naturalmente encuentran en las técnicas de reproducción humana asistida (TRHA), la vía a la ansiada familia. La maternidad subrogada se inserta en este contexto como una práctica peculiar, generalmente merecedora de un tratamiento distinto del resto de las técnicas de reproducción humana asistida. El presente trabajo estudia la postura de las jurisdicciones que no aceptan la gestación por sustitución, comparándolo al tratamiento favorable que reciben –en estas mismas jurisdicciones-, las demás técnicas de fertilización asistida. En un intento por comprender este enfoque diferente, posteriormente se aborda el principio heredado del Derecho romano, mater semper certa est, en tanto la práctica del “alquiler de vientres” lo afecta directamente.
