Summary: In this article, I analyze the most cited legal texts in a set of 107 judicial decisions of the Brazilian Federal Regional Courts (2006-2015) in trials in which the defendant was prosecuted for the crime of reducing someone to a condition analogous to that of a slave, contemplated in article 149 of the Brazilian Penal Code.I conclude that judges interpret article 149 in a restrictive way, limiting the scope of the legislative changes that this crime suffered in 2003. This restrictive interpretation is linked to conceptions of contemporary slavery prior to the 1988 Constitution, denoting a linear and continuist approach to the relationship between past and present criminal norms.
