Both perspectives give us room to conclude that current regulation of the social function, which allow limitations to property rights, is not different to the “common good” provision in the Fundamental Law of Germany. Then, such amendment does not contribute to the Chilean regulation of property right and, on the contrary, it could weak the protection of propertySe examinan críticamente dos iniciativas de reforma constitucional que se han planteado hace poco y que proponen incorporar a nuestra Constitución una cláusula que, siguiendo la Ley Fundamental alemana, disponga que la propiedad debe servir al bien común. Se analizan los aspectos básicos de la regulación de la propiedad en el constitucionalismo alemán y el alcance de la función social en el constitucionalismo chileno. Ambas perspectivas permiten concluir que la actual consagración de la función social como una fuente legitimadora de limitaciones al derecho de propiedad comparte similar trasfondo con la norma contenida en la Ley Fundamental alemana.
