Thus, it aimed to find sufficient elements with a view to the Brazilian racial dynamics. Taking as reference the critical criminology and the scientific method of historical-dialectical materialism, the work draws on historical-documentary research to provide a legal-sociological reading of the dynamics of power. In this way, it intends to understand how the structuring of the founding precepts of the legal structure serve to build the Brazilian conjuncture of mass incarceration and the genocide of the black people.O presente trabalho busca realizar uma análise da evolução do poder punitivo estatal, considerando-o como meio disciplinante dos corpos marginalizados, criados por um sistema cuja essência manifesta-se na verificação de desigualdades sociais. Assim, orienta­se a encontrar elementos suficientes para que o referido estudo seja feito com vistas à dinâmica racial brasileira. Tendo por referencial a criminologia crítica e o método científico do materialismo histórico-dialético, o trabalho vale-se de pesquisa histórico-documental para proporcionar uma leitura jurídico-sociológica das dinâmicas de poder.
