The present work seeks to perform an analysis of the evolution of the state punitive power, considering it as a disciplining means of the marginalized bodies, created by a system whose essence manifests itself in the verification of social inequalities. Thus, it aimed to find sufficient elements with a view to the Brazilian racial dynamics. Taking as reference the critical criminology and the scientific method of historical-dialectical materialism, the work draws on historical-documentary research to provide a legal-sociological reading of the dynamics of power. In this way, it intends to understand how the structuring of the founding precepts of the legal structure serve to build the Brazilian conjuncture of mass incarceration and the genocide of the black people. |
