dialnet-ar-18-ART00013416772019-10-03Republicanismo, Liberalismo e DireitoSellers, M. N. S.Republicanism is generally contrasted with Liberalism as two centrals and opposing ideas of modern legal and constitutional thinking. Both legal-political theories attract new meanings, in pursuit of various legal and political objectives. It is common for jurists to distinguish Liberalism, as one who considers law as the necessary evil; And Republicanism as being cultural self expression through law. But such a reading is misleading and ignores the historical origins and the best use of both terms. The present text aims to take a closer look at the fundamental origins and doctrines of Republicanism and Liberalism, revealing that its principles are not necessarily conflicting; And that each advocates law as the necessary instrument of social justice.O Republicanismo é geralmente contrastado com o Liberalismo como duas ideias centrais e opostas do pensamento jurídico e constitucional moderno.
