This paper analyzes the Fund as a unique mechanism to improve energy efficiency in view of the judgment of the European Union Court of Justice of August 7, 2018, case C-561/16. In this case, some operators in the energy sector questioned the Spanish model because it was based exclusively on the obtaining of economic resources.La Directiva 2012/27/UE relativa a la eficiencia energética, impuso a los Estados la obligación de conseguir unos objetivos de eficiencia para el año 2020. Esta norma dejó a las autoridades nacionales la elección de los medios para hacerlo dentro de un conjunto de alternativas posibles. En este contexto, España creó el Fondo Nacional de Eficiencia Energética para recaudar recursos, destinarlos a financiar las iniciativas de eficiencia energética del Estado y cumplir con los objetivos europeos.
