The regulation of crimes against independent human life in Spain suffered an important modification  through  the   Organic   Laws 1/2015  and  2/2015.  The  most  remarkable  was the consideration of one  of  the  modalities of hyper-qualified murder which led to the imperative application of one penalty  with  major repercussions: revisable permanent imprisonment. A review on the chronology  of  the most relevant murders before the reform attests on how the popular parliamentary group benefitted from the occasional social alert to turn the reform of these precepts and, thus this penalty, into an authentic electoral slogan. Precisely, the haste and opportunism that accompanied these laws turned out into a flawed regulation of homicide and murder and their correspondent qualifications, contaminated by a moralization of the unfair that had been allegedly surpassed, disturbingly inexcusable vinculation  of penal intervention to the identifiable legal assets, plagued of terminological imprecisions, devoided of systematic completion and susceptible to numerous problems on proceedings. Furthermore, the solutions that have been wielded against this legislative gibberish have not always been peaceably shared by the doctrine and legal practitioners. For all that, it can be concluded that only a return to a sober and systematic regulation of this penal types is possible, free of prejudices without an empiric basis and that adjusts the legislative technique with the proper political-criminal principles and Criminal Guarantees that take hold in the Constitution of our social and democratic State of law.

O mais notável foi contemplação de modalidades de assassinato hiperqualificados, cuja comissão demandou a aplicação imperativa de uma das penas mais famosas da reforma: a prisão permanente susceptível de revisão. Uma simples revisão da cronologia dos assassinatos mais importantes  dos anos anteriores à Reforma mostra como o grupo parlamentar popular, tomou a reforma como alarme ocasional social para converter esses preceitos e consequente punição em um slogan  eleitoral  real.   Precisamente   a   pressa   e o oportunismo que acompanhou essas leis mostrou regulamentação defeituosa de homicídio e assassinato e  suas  qualificações,  manchada por uma moralização dos injustos, foi feita historicamente superado, estranhamente,  longe o link imperdoável entre a intervenção criminosa dos interesses legais identificáveis, atormentado por imprecisão terminológica, a falta de conclusão sistemática e propensa a numerosos problemas de falência. Além disso, as soluções que foram apresentadas contra essa ladainha legislativa nem sempre foram compartilhadas pacificamente pela doutrina e pelos operadores legais. Portanto, concluiu-se   que   apenas   ser   um   retorno   a um regulamento sóbria e sistemática destas infracções, que dispensa preconceitos, sem base empírica e ajustar a técnica legislativa exigível sobre princípios político criminal e garantias criminosas enraizadas na a Constituição do nosso Estado social e democrático de direito.La regulación de los delitos contra la vida humana independiente en España sufrió importantes modificaciones a través  de  las  Leyes Orgánicas 1/2015 y 2/2015. La más destacable fue la contemplación de unas modalidades de asesinato hipercualificado cuya comisión conllevaba la aplicación imperativa de una de las penas más sonadas de la reforma: la prisión permanente revisable. Un mero repaso por la cronología de los asesinatos más relevantes de los años precedentes a la Reforma atestigua cómo el grupo parlamentario popular aprovechó la ocasional alarma social para convertir la reforma de estos preceptos y la consiguiente pena en una auténtica consigna electoral. Precisamente el apresuramiento y oportunismo que acompañó a estas leyes deparó una defectuosa regulación del homicidio y asesinato y sus correspondientes cualificaciones, contaminada por una moralización de los injustos que se entendía históricamente superada, inquietantemente alejada la inexcusable vinculación de la intervención penal a los bienes jurídicos identificables, plagada de vaguedades terminológicas, carente de compleción sistemática y proclive a numerosos problemas concursales. Además, las soluciones que se han esgrimido frente a este galimatías legislativo no siempre han sido pacíficamente compartidas por la doctrina y operadores jurídicos.
